The online store www.amlege.com (hereinafter referred to as "the Site") is published by Amlège Studio SARL, 2 rue Viollier, 1207 Geneva, Switzerland.
I. PURPOSE
1.1 These General Terms and Conditions of Sale define the rights and obligations of Amlège Studio SARL and the Customer with respect to the products presented by the company on the Site. They apply exclusively between Amlège Studio SARL and the consumer (hereinafter referred to as "the Customer") visiting or making a purchase via the Site.
1.2 No General Terms and Conditions that contradict or deviate from these General Terms and Conditions of Sale shall apply between Amlège Studio SARL and the Customer.
II. ORDER
2.1 The Customer must complete the corresponding online form to purchase items on the Site and submit it to Amlège Studio SARL. Before finalising their order, the Customer will have the opportunity to review its details and total price, and to correct any errors, before confirming it to express their acceptance. Any order confirmed by the Customer constitutes a sales contract and acceptance of all the provisions herein.
2.2 Upon receipt of a confirmation email summarising the order (products, prices, product availability, quantity, etc.), the Customer formally accepts the use of email for confirmation by Amlège studio SARL of the order details.
2.3 Failure by the Customer to comply with the obligations set forth in these General Terms and Conditions of Sale, and in particular any payment default for an order, may result in the suspension of access to the www.amlege.com service, or even the termination of their account, depending on the severity of the actions in question, without prejudice to any damages that Amlège Studio SARL may claim. Consequently, Amlège Studio SARL reserves the right to refuse any order from a person with whom such a dispute exists.
III. PRODUCTS
The products offered for sale are those described on the Website. Amlège Studio SARL takes the utmost care in the presentation and description of these products to best inform the Customer. However, it is possible that minor errors may appear on the Website, which the Customer acknowledges and accepts.
IV. PRICE
4.1 All product prices on the Site include VAT but exclude shipping costs. The total order price (including all taxes and shipping costs) is displayed in the shopping cart. Prices are shown and charged in Euros (or in Swiss francs for Switzerland only).
4.2 Amlège Studio SARL reserves the right to change its prices at any time, but products will be billed based on the prices in effect at the time the order is placed, subject to availability.
V. PAYMENT METHODS
5.1 The Customer pays for their order by credit card (Visa, MasterCard, Amex), PayPal, gift card, or store credit. Specific information regarding the payment process is provided when the Customer places the order.
5.2 Amlège Studio SARL retains ownership of the item until full payment of the price by the Customer. Purchases are made securely.
5.3 The data recorded and stored by Amlège Studio SARL constitutes proof of the order and all transactions. The data recorded by the payment system constitutes proof of financial transactions.
5.4 All information that the Customer provides to Amlège Studio SARL is strictly protected and guarantees the compliance and security of each transaction.
VI. DELIVERY
6.1 Delivery is made to the delivery address indicated by the Customer, which must be the Customer's residential address or that of any other individual of their choosing. Delivery cannot be made to a hotel or to Post office boxes.
6.2 To ensure timely delivery, the Customer must provide accurate and complete delivery address information. The stated delivery times are estimates, corresponding to average processing and delivery times. Amlège Studio SARL will keep the Customer informed of the progress of their order.
6.3 Deliveries within Switzerland are sent via Swiss Post in 2 to 3 business days. Deliveries to the EU are sent in 3 to 5 business days.
VII. RETURNS/EXCHANGES AND REFUNDS
7.1 Before returning any product, the Customer must indicate their intention by sending an email to the following address: contact@amlege.com
7.2 Damaged, incomplete, washed, soiled, or returned products, or products without their original packaging or label, will not be accepted for return, exchange, or refund.
7.3 Please note that during sales periods, orders will not be exchanged or refunded.
7.4 Returns can be made within 14 days of the delivery date. After this period, merchandise cannot be returned.
7.5 Returns of ordered products will result in a full refund of all sums paid by the Customer (purchase price of the product(s) excluding any delivery charges).
7.6 Returns and exchanges are at the Customer's own risk.
7.7 Product refunds will be issued by Amlège Studio SARL within a maximum of 30 days of receiving the returned products.
VIII. INDEMNIFICATION
You agree to defend, indemnify, and hold Amlège Studio SARL harmless from and against any and all losses, liabilities, damages, and/or claims (including, without limitation, attorneys' fees, costs, and expenses) arising out of your breach of this Agreement or resulting from your use or misuse of the Site, its content, or the products.
IX. MANAGEMENT OF PERSONAL DATA
The information collected by Amlège Studio SARL during a Customer order is necessary for processing the transaction and may therefore be shared, in whole or in part, with Amlège Studio SARL's service providers involved in fulfilling the order. The Customer is informed that this same data may also be collected by an organisation responsible for order analysis and combating credit card fraud.
The data registration process is used, in particular, for billing and shipping addresses. Information held by Amlège Studio SARL is protected by data protection regulations.
X. WARNING
Amlège Studio SARL reserves the right to modify these General Terms and Conditions of Sale. The latest applicable update is always displayed. Version 10.10.19
The conditions relating to the use of the website www.amlege.com are subject to Swiss regulations, and their meanings shall be determined in accordance with Swiss law.
XI. APPLICABLE LAW
All orders imply the Customer's full acceptance of these General Terms and Conditions of Sale. These General Terms and Conditions of Sale are governed by Swiss law. In the event of a dispute, the courts of the Canton of Geneva shall have exclusive jurisdiction.
